Welcome to OwnMyDay. These Terms of Service ("Terms") govern your access to and use of the OwnMyDay mobile application and related services (collectively, the "Service"), operated by OwnMyDay ("we", "us", or "our"), based at 19 Pellisier Road, Putney 2112 NSW, Australia.
By downloading, installing, or using OwnMyDay, you agree to these Terms. If you don't agree, please don't use the Service.
1. Who can use OwnMyDay
OwnMyDay is intended for use by adults (parents, caregivers, educators, and clinicians) to support children in their care. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.
2. Your account
You may need an account to use some features. You're responsible for keeping your login credentials confidential and for activity that happens under your account. If you notice unauthorised use, email Zane.saboune@gmail.com right away.
3. Free and Pro plans
OwnMyDay is free to download. OwnMyDay Pro is a paid subscription, billed monthly or annually through the Apple App Store or Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription from your App Store or Google Play account.
Refunds are handled by the store where you purchased the subscription, subject to their policies.
4. Your content
You own the photos, audio recordings, schedules, and tile sets you create or upload ("Your Content"). You grant us a limited licence to store, process, and display Your Content solely to provide the Service to you.
You are responsible for Your Content and for making sure you have the right to upload it. Don't upload content you don't own or don't have permission to use.
5. Acceptable use
Don't use OwnMyDay to:
- Upload unlawful, harmful, or infringing material
- Interfere with or disrupt the Service
- Attempt to access other users' accounts or data
- Reverse-engineer, decompile, or tamper with the app
- Use the Service to harm, exploit, or endanger a child
6. Clinic sharing
If a clinician shares a tile set or schedule with you via a clinic QR code, you are receiving Their Content under a limited licence to use inside OwnMyDay. Don't redistribute or publish shared content without the clinician's permission.
7. Medical and clinical disclaimer
OwnMyDay is a tool to help organise visual schedules. It is not a medical device, diagnostic tool, or replacement for professional assessment or therapy. Always follow the guidance of a qualified clinician regarding your child's care.
8. Service availability
We work hard to keep OwnMyDay running, but we don't guarantee uninterrupted availability. We may update, change, or discontinue features at any time. The app is designed to work offline once set up, so most functionality remains available even during server outages.
9. Our intellectual property
OwnMyDay, the name, logo, wordmark, and the design of the app are our property. You may not copy, modify, or create derivative works from the Service except as allowed by law or explicitly permitted in writing.
10. Termination
You can stop using OwnMyDay at any time by deleting the app and, if you'd like, your account (see Account deletion). We may suspend or terminate access if you violate these Terms.
11. Disclaimers and limitation of liability
OwnMyDay is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, our total liability to you for any claim arising from or related to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.
We are not liable for indirect, incidental, consequential, or special damages.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll let you know inside the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales, unless a consumer-protection law in your jurisdiction gives you a non-waivable right to bring a claim elsewhere.
